Dissolution of Civil Partnerships
This is an area of law in which family lawyers have only a small amount of practical experience. It became possible to register a Civil Partnership in 2005, and the first dissolution of a Civil Partnership took place in 2006. There is not a great wealth of experience, case law and precedent available for this area of law for divorce lawyers to turn to for guidance.
The procedure for obtaining dissolution of a Civil Partnership is very similar to divorce and the Collaborative Law process can be a particularly appropriate way of resolving problems which arise in this area. Please click here for more information, call 01284 763333, or email eah@gross.co.uk.
How Courts will approach financial settlements between civil partners largely remains to be seen. Civil Partnerships which are being dissolved now will all be of relatively short duration. This is a significant factor affecting the manner in which a Court approaches the division of capital assets in particular, between the couples.
This is a new area, for all family lawyers. It will be a case of "watch this space" for some years to come.
